Terms of use

1. General Terms

The Limited Partnership under the name 'TRANSFER SERVICES S.A. ", with registration number 163972103000, registered office in the Municipality of Elliniko, Attica, Tax ID 801820991, Tax Office of Ilioupolis, email [email protected] (hereinafter the "Company"), has launched and manages the digital platform called "Transfer Services" (hereinafter the "Platform"), which enables you who browse it or use the Platform to receive the services provided through it (hereinafter the "Users") to book by taxi/van (hereinafter the "Vehicle") a transfer service to and from the airport, ports or other pick-up and transfer point (hereinafter the "Transfer Services"), as defined in these taxicity.services Terms of Use. Transportation is provided to the User and the passengers who will use the Transfer Service (hereinafter the "Passengers"), by professional drivers who receive notifications and requests for the provision of Transfer Services to the Platform Users. The drivers have an employment relationship with the Company (hereinafter the "Drivers"). The requests and information of the Users are transmitted to the Drivers by an employee of the Company which manages the Platform.

2. Acceptance of Terms of Use

2.1 By browsing or using the Platform to obtain Transfer Services, you state that you have read and accepted these Terms of Use. By accepting these Taxicity.services Terms of Use (the "Conditions d'utilisation"), you enter into a contract/binding relationship between regarding your access and use of the Platform and the Transfer Services.

2.2 Before you navigate and use the Platform, you must read these Terms of Use. In case you disagree, please discontinue your navigation on the Platform or do not request to receive Transfer Services.

2.3 Any clarifications we provide you in any way do not constitute a modification of these Terms of Use.

2.4 By accepting these Terms of Use, you state that you are an adult.

3. Use of Platform

3.1 You can book a Vehicle through the website https://taxicity.services by filling in your details in the "RIDE DETAILS" form.

3.2 In addition or alternatively, you have the possibility to book a day trip by selecting one of the tours presented on our Platform, in the subsection "TOURS", by filling in your details in the "BOOK NOW" form. In each photo of the relevant destinations, you have the possibility to be briefly informed about basic information regarding the destination of the excursion and its cost.

3.3 You can be informed about the taxi transfer charges from and to the airport or ports of Athens, according to the established taxi transfer charges.

3.4 You can contact us by selecting any of the means of communication displayed on the Platform under the “Contact Us” section.

4. Booking Policy

4.1 Our Platform operates exclusively in Athens and the areas shown in the respective fields of the "RIDE DETAILS" form. In any case you have the possibility to get more information by contacting us.

4.2 In order for us to be able to provide the Transfer Services, you must fill in all the required details found in the "RIDE DETAILS" form, such as pick-up point, destination point, way of travel (one way or round trip), date and time of the start of the trip, number of Passengers and number of baggage. As a next step you need to select Vehicle type. The Platform will also display the cost of the Transport Services taking into account the above information. Next, you will need to enter your full name, your address, your contact details (phone and e-mail) and if you wish you can fill in the flight number or the name of the departure or arrival ferry and any other information you deem necessary. In case your pick-up point or destination is the airport or ports we recommend you to enter the flight number or the name of the departure or arrival ferry in order to calculate correctly the time of your transfer and pick-up from and to it.

4.3 If the information required to be provided (e.g. pick-up point, destination point) is incomplete or inaccurate, we reserve the right to refuse to provide the Transfer Services.

4.4 When you make a Vehicle transfer booking via the Platform, we will contact you to confirm receipt of the booking. In any case, your request for your booking must be submitted by you in good time in order for us to be able to accommodate you.

4.5 When we receive your request to book a Transfer Service, we will review it to determine whether we are able to accommodate you or whether there are reasons to reject it in accordance with these Terms of Use. We reserve the right to reject a booking request for any reason, including legal reasons. If your request is rejected we will contact you directly at the contact details you have entered in the "RIDE DETAILS" form.

4.6 NOTE: THE PROCESS OF COMPLETING THE ONLINE BOOKING WILL TAKE PLACE WHEN THE CONFIRMATION MESSAGE IS SENT TO YOU. THE TRANSFER SERVICE IS COMPLETED WHEN YOU ARE TRANSFERED TO THE DESTINATION POINT YOU HAVE INDICATED AND PAID FOR THE SERVICE BY THE METHOD YOU HAVE CHOSEN (CREDIT/DEBIT CARD OR CASH), SUBJECT TO THE CONDITIONS SET OUT IN POINT 8 BELOW.

4.7 Each User is solely responsible for submitting correct and true information when making a booking for the provision of Transfer Services by the Company.

4.8 The Company reserves the right to verify, through the payment provider used, the payment details you provide to us when you select credit/debit card as a means of payment. In the event of any problem occurring during the process of reserving an amount by card we have the right to reject your booking or request an alternative method of payment.

5. Cancellation Policy

5.1 Each User has the right to cancel a transfer through the Platform, for they have made a reservation, at any time, by contacting the Company at its contact details (telephone 6944439959 and e-mail [email protected]) in accordance with the terms set out in this article.

5.2 If you have already prepaid for the trip with a credit or debit card and the Company receives a request from you as a User to cancel the reservation:

5.2.1. if the request is received up to 6 hours before the scheduled pick-up time, you will be charged a cancellation fee of 20% of the amount you have already paid, while the remaining 80% of the transport cost will be refunded to you.

5.2.2 If the request is received less than 6 hours before the scheduled pick-up time, the cancellation will be considered a “last minute” cancellation and in this case the amount paid by you will not be refunded and as a result you will be required to pay the full amount of the transfer as a cancellation fee, and you will not receive any refund.

6. Transfer Service Modification Policy

6.1 To modify your reservation you can contact us at +306944439959 or on our website or by sending an e-mail to [email protected] up to 3 hours before the scheduled pick-up time.

6.2 In the event that the pick-up point or destination is changed or baggage is added or another essential element of your transfer is changed, the cost of the transfer may be amended accordingly. In this case we will inform you, regarding the new cost of your transfer, which you must accept by contacting us.

6.3 In the event that you have already prepaid for your transfer and the cost of the new transfer is lower, the Company will refund the remaining amount. If it is higher, you will need to pay the additional amount in the manner you choose. If the means of payment is your credit/debit card, you will need to authorize us for the additional charge.

7. Waiting Time Policy

7.1 The Vehicle Driver will wait for you at your pick-up location at an additional charge for as long as it takes, up to 10 minutes.  The corresponding waiting time is 20 minutes at bus stations and ports and 60 minutes at the airport. For this reason, you must show up on time at the pick-up point at the scheduled time according to the reservation. The Driver will wait for you at the pick-up location at the time scheduled in the booking order, subject to the provisions of this Policy.

7.2 You may request the Driver to extend the waiting time by contacting the Driver on the telephone number sent to you with your booking confirmation message for an additional 10 minutes beyond the time specified in paragraph 7.1. The Driver will then inform the Company accordingly in order to investigate whether there such possibility for the additional time requested by you. The cost of the additional waiting time shall be paid to the Driver either in cash or by credit/debit card.

8. User’s No-Show Policy

8.1 You are considered not to have shown up for the provision of the Transfer Service if you are not at the pick-up point specified in your booking by the end of the waiting time as described in paragraph 7.1, or the additional waiting time as described in paragraph 7.2. In case you do not show up at the exact pick-up point by the end of the waiting time, then the transfer fee will be paid in full and the amount of the transfer will not be refunded to the User. In any case, the Driver will try to contact you via SMS or will try to call the telephone number you have provided if you are not at the pick-up point.

8.2 Please contact the Driver of the Vehicle in good time in case of delay. If you do not contact the Driver the Company may release the Driver and not wait for you, considering that you have not showed up.

8.3 You have the option to dispute your no-show within 24 hours of the time set as the pick-up time in accordance with the booking. If, however, the Driver was at the pick-up point in accordance with the Company's procedures, we reserve the right not to refund any amount charged once it has been paid.

9. Driver's No-Show Policy

The Driver who will be attending you must be at the exact pick-up point at the scheduled time according to your booking. If the Driver is up to 10 minutes late, they will contact you at the telephone number you have provided as early as possible and at the latest by the scheduled pick-up time. In the event that the Driver is more than 10 minutes late, then they will inform the Company, who will then contact you informing you accordingly.

10. Buggage Policy

10.1 When you make a reservation for your transfer, you are required to indicate the number of pieces of baggage you wish to carry during the transfer on the "RIDE DETAILS" form. Each item of baggage is counted separately, except for small handbags.

10.2 In the event that you wish to carry special baggage such as baby carriages, pet carriers, etc., you must notify us in advance. If there is a special need for assistance from the Driver you will also need to specify this. If we need clarification we may contact you.

10.3 Each piece of luggage must not exceed 15kg.

10.4 In the event that you request more baggage whose volume can be supported by the Transfer Vehicle, their carriage is permitted.

10.5 In the event that the number or volume of Baggage is more than 2, the Company may add an additional charge. In the event that the Vehicle cannot carry the additional baggage, the Driver will assist you in finding another Vehicle for your transportation. The Company will receive 20% of the cost relating to the booking made and you will pay the full cost of the new transfer.

11. Excess Passengers Policy

In the event that the User appears with more passengers than the number they have declared, the Driver will contact and inform the Company before the start of the transfer. If the additional number of Passengers results a different cost of the transfer, the Company will recalculate it and will inform you accordingly in order for you to accept the new charge. If there is insufficient space in the Vehicle, the Driver will assist you in finding another Vehicle for your transfer. The Company will receive 20% of the cost relating to the booking made and you will pay the full cost of the new transfer.

12. Refunds Policy

In case the charge for the Transfer Service has been paid, except as mentioned above, the Company will refund your money in the following cases:

  • If the booking is cancelled for reasons of force majeure
  • If the booking is cancelled by the Company for reasons regarding the impossibility of the Vehicle’s arrival.
13. Users and Passengers Obligations

By using the Transfer Service, as a User, you are obliged:

  • to provide true and accurate details and information about yourself in the "RIDE DETAILS" form and in any field or tool you enter your details in. The Company may not and is not required to cross-check your information
  • not to use the Platform to spread viruses or any offensive or obscene content or anything that may damage the reputation of the Platform
  • to comply with the applicable legislation on the carriage of passengers
  • not to cause damage to the Company's Vehicles
  • to behave in a courteous and respectful manner towards Drivers
  • not to obstruct the Driver while driving
  • not to attempt to alight or board the Vehicle when it is moving
  • not to smoke in the Vehicle 
  • to observe the health rules in accordance with the legislation in force
  • not to open windows and doors without the consent of the Driver
  • to ensure that children, animals and luggage are carried responsibly
  • to keep the Vehicle clean and to not consume food or drink during the journey
  • not to throw objects outside the vehicle

In addition, you guarantee that all other Passengers using the Transfer Service comply with the abovementioned rules.

14. Company’s Rights

14.1 The Company may unilaterally deactivate the Platform at any time or suspend any of its functions.

14.2 The Company may temporarily suspend the operation of the Platform for technical maintenance and/or upgrading of the Platform or for any other reason. In any case, the Company will inform the Users through its website.

14.3 The Company may discontinue the Transfer Service in the event that the User objects to these Terms of Use.

14.4 The Company shall take appropriate measures for the proper operation of the Platform, however, it cannot guarantee its efficient operation, especially in cases of network malfunction. Using the Platform from your mobile device may incur internet charges depended to the telecommunications provider you are using.

14.5 The Company shall not be liable to the Passenger for any civil or criminal liability for any damage based on: 

1. a delay in the transmission of data or information due to a malfunction of the User's telecommunications provider or network.

2. temporary or permanent interruption of the operation of the Platform due to a technical malfunction related to the above

3. events, actions and/or omissions of the Company or third parties for which no guarantee is provided by the Company and which are not regulated by these Terms of Use

4. violation of these Terms of Use of the Platform by the Users or third parties

5. failure of the electronic system in the process of transferring electronic information that may lead to, but not limited to, loss of data, non-delivery or incorrect delivery, system downtime, damage to electronic files, etc.

6. any discrepancy between the time of the Platform system and an official designated time system

7. inappropriate or illegal conduct of the Drivers, or failure to appear other than as stated herein

8. loss of Baggage during transfer or in the event of an accident

9. force majeure events

14.6 It is expressly agreed that the Company is only liable for direct damages that can be caused by malice or gross negligence. The Company's liability for indirect or consequential damages is expressly excluded, regardless of the cause from which they arise. It is expressly agreed that the Company's liability shall be limited to the amount of the cost of transfer subject to any special legal provisions or special arrangement contained herein.

14.7 The User accepts that the aforementioned limitations of liability and indemnity are fair, reasonable and valid even if these Terms of Use are not met or held to be invalid or unenforceable.

15. Charges Policy

15.1 The Company accepts payments through Paypal and Livepay electronic payment systems.

15.2 The cost for using the Transfer Service ("Transfer Cost") is the amount displayed on the Platform at the time of booking or payment. 

15.3 In the event of a refund, the amount of the refund shall be equal to the Transfer Cost, subject to the more specific provisions set out in these Terms, and shall be refunded to the User depending on the method used to pay the Transfer Cost.

 

16. Disclaimer

By entering into this Agreement and using the Platform or the Transfer Services, you agree and expressly state that you waive any indemnification by the Company with respect to: a) any damage you may suffer due to the use or inability to use the Platform, or delayed response for technical reasons and/or the existence of a virus on the Platform and/or the servers hosting it; b) additional services that may be provided by the Driver; c) any form of material or other direct or indirect damage, bodily injury and/or death caused by the actions or omissions of the User (or third parties connected to the User), including any cancellations of double bookings, reasons of force majeure or any other reason outside the Company's sphere of influence; d) any information hosted outside the Platform or our website and which you may be directed to through a hyperlink, for which we have no control and responsibility.

You further agree that you will fully indemnify the Company, its employees, associates and any third party not expressly mentioned, for any costs forced to pay (including court costs and attorneys' fees) that arise from, relate to or concern compensation for direct or indirect damage to them or third parties, punitive damages, loss of revenue or profit for inaccurate, false or misleading information (including references to personal data) that may be contained in any comments, reviews by you or Passengers, and for any breach by the User of these Terms of Use or the Law which is not expressly referred to above.

17. Intellectual Property

17.1 The intellectual property rights of the Platform (such as, but not limited to, software, philosophy, appearance, methodology, design technique, algorithm, know-how, configurations, instructions for use, documents related to the Platform, texts, graphics, logos, images, etc.) belong to the Company or the legal owners and are protected by the applicable copyright legislation. The display and promotion of the content of the Platform shall not be regarded as a transfer and/or assignment of a license and/or right to use it.

17.2 You may store, print and display the available content solely for your personal use.

17.3 The name "Transfer Services", trademarks, signs, logos, distinctive features are exclusive trademarks and are protected by Greek and European trademark legislation.

17.4 It is prohibited to download and use all or part of the content from the Platform and the Website without express written permission. Any such permission does not imply the right to sell or commercially use them, which is expressly prohibited.

17.7 It is prohibited to publish, manage, sell distribute, copy in whole or in part, transfer, process, store, republish, modify or otherwise reproduce, create copies in any form or otherwise exploit the Platform or any part of the content or copies of the content appearing on the Platform for any commercial purpose without the written consent of the Company.

18. Applicable Law and Jurisdiction

18.1 These Terms shall be governed by and construed in accordance with the Greek Laws. You agree by accepting these Terms of Use that you submit to the exclusive jurisdiction of the courts of the city of Athens.

18.2 You can resolve consumer disputes electronically through the Alternative Dispute Resolution (ADR) procedure throughout the European Union. This method of dispute resolution also concerns the resolution of any disputes that may arise from the contract between our Company and you as Users regarding the provision of the Transfer Services through the Platform. You can initiate the ADR procedure through the single pan-European platform for electronic dispute resolution (the EDR platform) available at https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguage which enables consumers and suppliers to submit any disputes arising from the provision of services via the Internet to an online dispute resolution procedure. The certified Alternative Dispute Resolution (ADR) Body for this purpose in Greece, is the European Consumer Centre Greece (ECC GREECE) - Consumer Advocate, Avenue of Athens, Greece. The ADR procedure is based on the law, and it is non-binding for the parties, who may withdraw from it at any time. 19. Validity and modification of the Terms of Use

It is essential that you visit this website regularly to keep up to date with any changes to the Terms of Use. We reserve the right to:

a) change part or all of these Terms of Use at any time, without justification and without prior notice to you. Any changes will be effective from the time they are posted on our website

b) update or upgrade some or all of the content of our website

c) update or upgrade part or all of the external appearance or the structure or composition of the website and its technical specifications

(d) restrict access to all or part of the website

The Company reserves the right at any time, to cancel, permanently or temporarily suspend or terminate the operation of the Platform, without justification and without prior notice to you.
